Terms of Service
These terms apply to the use of www.capiworld.com.au and to the supply of goods by Capiworld Australia Pty Ltd (ABN 59 651 602 916) ("Capiworld", "we", "us"). By requesting a quotation or placing an order, you agree to these terms.
1. Quotations and pricing
Prices are not published on this website. All products are supplied to order, and pricing depends on thickness, R-value, panel size, surface finish, quantity and delivery location.
A quotation is an invitation to order, not an offer capable of acceptance. Quotations are valid for 30 days from the date of issue unless stated otherwise, and are subject to change where the specification, quantity, delivery location or material costs change. All prices are in Australian dollars and exclude GST and freight unless expressly stated.
2. Orders
A contract is formed only when we issue a written order acknowledgement. We may decline an order, in whole or in part, before that point.
You are responsible for the accuracy of the specification you provide, including thickness, R-value, dimensions and quantity. Because goods are made to order, specification changes may not be possible once production has commenced.
3. Payment
Payment terms are as stated in your quotation or order acknowledgement. Unless agreed otherwise in writing, payment is due before despatch. We may require a deposit for made-to-order goods.
4. Lead times and delivery
Lead times quoted are estimates given in good faith and are not guaranteed. We are not liable for delay caused by events outside our reasonable control, including shipping delays, customs clearance, supplier delay, industrial action or natural events.
Risk in the goods passes to you on delivery to the nominated address or on collection. Title remains with Capiworld until payment is received in full.
You are responsible for providing safe and suitable access for delivery vehicles and for unloading unless otherwise agreed in writing.
5. Product information and specification
Technical data, test results, R-values and specification clauses published on this website are provided for general guidance. They describe the tested performance of the product under the stated test method and conditions.
Fire performance. Where a Class A rating to ASTM E84 is stated, this is a United States test classification describing surface-burning behaviour. It is not a classification of non-combustibility and is not a Group Number under AS 5637.1. Results reported to AS/NZS 1530.3 are indices from that test method. It is your responsibility, together with your building certifier or fire engineer, to confirm that a product meets the requirements applicable to your building.
Thermal performance. Minimum R-values depend on climate zone and building class. Confirm requirements with your building designer or certifier.
You are responsible for satisfying yourself that a product is suitable for your intended application. Installation must follow our published installation instructions and all applicable codes and standards.
6. Warranty
Products may be covered by a manufacturer's warranty as set out at Capiworld. Any such warranty is in addition to, and does not limit, your rights under the Australian Consumer Law.
7. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.
Where our liability may lawfully be limited, our liability for a failure to comply with a consumer guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.
To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of contract, or costs of removal or reinstatement of other building elements.
8. Intellectual property
All content on this website, including text, images, technical data, the ECO-AEROGELSâ„¢ name and the Capiworld name and logo, is owned by or licensed to Capiworld. You may not reproduce, distribute or use it commercially without our written permission. You may download and print technical data sheets for the purpose of specifying or purchasing our products.
9. Website use
We take reasonable care to keep the information on this website accurate and current, but we do not warrant that it is free from error or that the site will be available without interruption. We may change products, specifications and content without notice.
10. Governing law
These terms are governed by the laws of [BANG], Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that State.
